Terms of Use

Effective date: April 24, 2026

These Terms of Use ("Terms") govern your access to and use of the Hero Habits mobile application ("the App") provided by Hero Habits ("we", "us", or "our"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

By accessing or using Hero Habits you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms form a binding agreement between you and Hero Habits.

2. Eligibility

You must be at least 13 years old to use Hero Habits. By using the App you represent that you meet this requirement. If you are under 18, you represent that you have obtained parental or guardian consent.

3. Your Account

You may use Hero Habits as a guest (no account required, limited to one habit) or by creating an account with a valid email address. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at hello@herohabits.eu if you suspect unauthorized access.

4. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable law or regulation.
• Harass, threaten, or abuse other users through social features such as the activity feed, cheers, or follows.
• Post false, misleading, or offensive content in your profile or publicly visible habits.
• Attempt to reverse-engineer, decompile, or extract the source code of the App.
• Use automated means — bots, scrapers, or scripts — to access or interact with the App.
• Interfere with or disrupt the App's servers, infrastructure, or other users' experience.

We reserve the right to remove content and suspend or terminate accounts that violate these rules, at our sole discretion and without prior notice.

5. User Content

Hero Habits includes social features such as user profiles, an activity feed, and cheers. Any content you make public — including your username, bio, and non-private habit names — is visible to users who follow you. You retain ownership of your content, but you grant us a limited, non-exclusive, royalty-free license to display it within the App for the purpose of providing the service. You are responsible for ensuring that anything you share does not infringe third-party rights or violate these Terms.

6. Subscriptions and Billing

Hero Habits offers free and paid tiers. Paid subscriptions (monthly, yearly) and one-time purchases (Founding Member lifetime access) are processed exclusively through Apple's App Store. By subscribing you agree to Apple's payment terms.

• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period.
• We do not process or store any payment information directly.
• Refund requests are subject to Apple's refund policies and must be submitted through Apple.
• Prices may change. We will notify users in advance of any price changes affecting active subscriptions.

7. Intellectual Property

All content in Hero Habits — including the name, logo, design, code, and copy — is owned by or licensed to Hero Habits. These Terms do not grant you any right to use our intellectual property beyond what is strictly necessary to use the App as intended. You may not reproduce, distribute, or create derivative works from any part of the App without our prior written consent.

8. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the App will be uninterrupted, error-free, or that your data or streaks will never be lost. Use the App at your own risk.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Hero Habits shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the App. This includes but is not limited to loss of data, lost streaks, or loss of profits, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim, or €10, whichever is greater.

10. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if we reasonably believe you have violated these Terms. You may stop using the App and delete your account at any time from within the App's settings. Upon termination, your right to use the App ceases immediately. Sections 7, 8, 9, and 11 survive termination.

11. Governing Law

These Terms are governed by the laws of Hungary, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Budapest, Hungary — unless mandatory consumer protection law in your country of residence requires otherwise.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Effective date" at the top of this page and, for material changes, notify users via the App or email. Your continued use of the App after changes constitutes acceptance of the updated Terms.
